Tree and hedge disputes
We work with stakeholders who are affected by or may cause a severe loss of view from a window or similar location as a result of the growth of vegetation.
Vegetation that causes significant view loss may constitute a hedge in the terms of relevant legislation that provides for a right of appeal to the Land and Environment Court of New South Wales.
If it is found to have jurisdiction in the circumstances, the Court may make an order to secure relief from the effects of the hedge, such as having it pruned, taken down or re-planted with more appropriate species of plants.
We advise on the many matters to be taken into consideration in making an appeal to the Court and provide expert testimony on view lost, if appropriate.
